Them refusing to refund me is illegal under the Ontario Consumer Protection Act, 2002 — section 21(1) —which states if a service is cancelled and not provided, the customer is entitled to a full refund. While there is an exemption allowing businesses to issue credits instead of refunds, that only applies if the customer clearly and knowingly agreed to that beforehand. Since their policy is unclear and I was never given a clear choice, that exemption does not apply here. I will be seeking legal recourse with Long Point Eco Adventures. As someone who travels frequently and does tours often, I am shocked by Eco Adventures poorly written policies as well as their refusal to offer a refund.
