We lost a $50,000 trip with this dishonest business

点评:I have given this review a lot of thought before posting as I know negative online reviews can hurt a business. However I have given owners Chelsea and Keegan McCarthy plenty of time to make our negative experience right and they have done nothing but cause legal fees to pile up for us. I don’t want this to happen to anyone else. This $50k cruise was supposed to be the trip of a lifetime. However, it was cut short after the chef quit because he was afraid of getting covid after one passenger tested positive.
The owners had no covid protocols so when one of our family members felt ill they self tested and quarantined to their room. Covid tests were not required for any passengers or crew. The chef had a panic attack, laying on the floor saying he had a medical condition and could not get sick. The three other crew members wanted to continue the cruise however the owners could not find a replacement for the chef and the other crew members refused to take on the chefs duties. After we returned to port on day 3 of our 7 day cruise, the chef left, taking cooking equipment with him. The owners told us they were trying to find a replacement chef or purchase catered food for the rest of the trip; however, we sat for a day in port with no food and no offer to pay for our food and little communication from the owners.
Another one of the crew members left the boat when the chef departed and stayed out all night not returning to the boat until morning. The next day that crew member said they weren’t feeling well and left the boat.
The owners then immediately emailed us a letter from their attorney and ordered us to vacate the boat. They offered no
Compensation even though this was their personnel issue instead telling us to file a trip insurance claim.
Before we booked this $50k vacation we specifically asked in writing what would happen if the boat or crew could not perform and we were reassured in writing thay we would be refunded if that was to happen and they had survived covid and weren’t worried about that. They said trip insurance would cover us if WE couldn’t make the trip.
After attempting to arbitrate with them per the contract we learned their arbitration clause had never been reviewed by the American Arbitration Association (AAA). So they tried to wiggle out by saying we needed to agree to the business rules of arbitration rather than consumer rules (we are a family not a business) and refused to waive the venue (if you don’t live in Juneau you will have to go there for any legal action). After we paid the fees the AAA said they would not handle any arbitrations with this business going forward because of their refusal to pay the fees associated with reviewing the clause before putting it in a contract. It is our belief the owners are dishonest people who not only accused us of purposely infecting their crew with covid but also falsely stating they lost their crew for the trip after ours because they got sick. In fact all of the crew except one told us that was their last trip of the year and the other one was seen on instagram posting pictures from the boat the week after our trip.
Based on the above we only asked for a 50% refund. We didn’t ask for the airline change fees or hotel or food we were forced to pay when our family was left stranded in Juneau.
